    Awesome, so… I don’t expect him to be arrested or impeached, or for there to even be an investigation or anything.

    I’m hoping for something more realistic like taking away his screen time for the weekend, or at least till he says he’s sowwy.

      Exactly, stop going after trump. Go after every officer and government agents who followed those orders. See how fast they enforce his bullshit when they’re facing personal consequences

          Yeah, but maybe Trump issuing illegal orders to the military and offering pardons to those that follow them would be the catalyst Congress needs to pass an amendment limiting presidential pardon power.

    A federal judge has ruled that President Donald Trump acted illegally in deploying the National Guard to address protests in the Los Angeles area.

    In a ruling issued Thursday evening, U.S. District Judge Charles Breyer wrote that such use of the National Guard was a violation of the Tenth Amendment to the Constitution and exceeded the statutory authority granted to the president.

    The order, which takes effect Friday, says the administration must return control of the California National Guard to the state of California.

        He does, but anyone following illegal orders doesn’t. Sure, he could pardon them, but only after a long, expensive, and potentially life-changing legal battle after which they’re convicted.

        That doesn’t sound like a fight most regular troops should want to gamble on.

          Pardons can be pre-emptive, as long as the illegal act has already occured. (Pardons cannot apply to a future crime that haven’t happened yet.)

          Just look at Ford Pardon Nixon.

            That’s true, but trump is transactional. He and Giuliani were selling them for 2 million a pop. How many military regulars can afford one? Why should trump care to pardon them if they can’t give him something?

            If I was rank-and-file, I wouldn’t take that bet.

          It does seem the power of the judiciary will be challenged quite soon.

          It will probably be with a tweet saying “Make me. You and what army?” and the courts will need to rely on the US military choosing the Constitution over the Commander in Chief.

          May we all have the fortune to live securely in less interesting times. I suppose it is our duty to make that happen.

        Might be true, but since the orders are illegal, the NG are following illegal orders if they continue, meaning potential court martial (depending on many factors).

      The National Guard should release all arrested protesters, return to base and tell the Governor of California that they are “reporting for duty”. If not, they are traitors (already before but then even more so).

      The legal system is just not equipped to deal with the threat implied by Trump.

      In the US it seems like judges are just another executive arm of the government anyway.

      The few actual judges still considering the law just get perpetually paused with appeals and what have you.

      So…just let him keep breaking the law until it reaches the Supreme Court? I thought they were supposed to pause his actions, pending appeal…not let him keep going.

      The question is whether the California National Guard will follow Trump’s orders or Newsom’s orders in a situation where a court has ruled that Newsom is who they currently work for.

      It’s paused on appeal now, but there was never going to be a consequence for Trump personally because he’d argue “official act.” There’d only be the return of control of the CA National Guard troops to Governor Newsom So they could be sent to help with wildfire situations, for instance. Then again, will people even trust them to help with an evacuation anymore?

        Yeah, everyone should remember that the Supreme Court fucked you all by paving the way for this, and the rest of the Legislative branch as well by either ignoring their duty or actively supporting a massive overreach in power and outright ignoring existing limits.
